The Terms
The Terms and Conditions set out below constitute the agreement between the client (You) and JMJ—EA for a Day and cover a range of services.

- Web build
- Web maintenance
Compliance
JMJ – EA for a Day will always comply with the Australian Consumer Law for Business Services. You can find out more about your rights and obligations as a consumer on the ACCC Website
Warranties
JMJ – EA for a Day accepts liability for the supply of service to you to the extent of what is provided in your Scope of Works and the accepted Quote.
JMJ does not warrant the following:
- The services provided by external service providers.
- Hacking attempts, viruses, worms, malware, SPAM, trojan or other malicious attacks.
- We are not liable for any loss of business, contracts, online sales, profits, or any indirect economic loss resulting from delivering the final website.
- If you have taken over an existing website from a previous business, we cannot provide a warranty for the work that has already been undertaken.
Payment Terms
Deposit—Once the quote has been approved, a 50% deposit of the agreed price must be paid upon receipt of the invoice. Once the funds have cleared the bank, work will commence as per the Scope of Work.
Final payment—The 50% balance of the agreed price is to be paid upon receipt of the invoice. Once the funds have cleared at the bank, the completed website will be returned to the client.
We only accept payment in AUD via bank transfer; we provide full payment details on our invoices.
JMJ–EA for a Day is registered for GST, which will be visible on your Tax Invoice.
Refund Policy
No refund will be issued if you change your mind and decide you no longer want the work to continue with JMJ.
If you decide to halt work on your website for a while, all work will cease and remain in abeyance until you wish to recommence. After 8 weeks in abeyance, a new quote to complete the work may be necessary.
We are unable to offer a refund on the following services as they are via 3rd party suppliers and require payment at the time of set-up:
- Domain names
- Web hosting
- SSL certificates
- Software licenses and plugin purchases
- Custom programming and web-related services
Ownership
Once we receive the final payment, full ownership of the website and management (if you are not taking website maintenance) will transfer to the client and you will be responsible for the management, updating, and maintenance of your site.
You retain full ownership of any content, images, videos, materials, including any documents you provide from conception to finalisation.
Use of Identity
You agree to allow JMJ–EA for a Day to use your business name and logo for inclusion on our portfolio to identify you as a client. We can include testimonials where they have been received personally, via social media, or in any public domain on our website’s testimonials. We may also, from time to time, share your testimonial on our social media platforms.
Website Content
You will take all reasonable steps to ensure that you have provided all relevant warnings on our website if any or all of your content is not suitable for children or any person under the age of 18, that your content is appropriate for the purpose it is intended, and that you comply with all applicable laws and relevant industry policies as relevant to your location and copyright laws.
You will make good all attempts to provide all materials, content, PDFS, images, and videos for your website in a timely manner. Failure to do so will delay your delivery timeline.
User Material
Your material/content may or may not be limited to:
- IP
- Content
- Images
- Videos
- Audio
- PDF files
Your content must not be unlawful in any way or infringe on any third-party rights. Any images you provide for your web project are provided because you have the right/license to do so.
You allow JMJ–EA for a Day the right to resize any graphics as we see fit to ensure they fit and look good on your project.
Hosting
If you want to change hosting services or want JMJ–EA for a Day to organise hosting, we can do that. We use an Australian server company based in Melbourne, which uses Australian servers only. We are an approved web hosting reseller.

eCommerce
You are responsible for all user content, media, graphics, and events. You are responsible for complying with all legal obligations when using your eCommerce website. You acknowledge that you own all content and are not violating copyright or IP Infringements.
All payments accepted through your eCommerce site are processed via your preferred third-party provider, and you comply with your third-party applications’ terms of use and privacy policies.
Third-Party Providers
JMJ–EA for a Day works with Australian and offshore providers to undertake the technical aspects of your project. As mentioned in the Scope of Work, you are financially responsible for any works undertaken by third-party providers that will form part of your quote. You are also responsible for any unscoped work you require to be completed with your approval.
JMJ–EA for a Day cannot guarantee the service or reliability of any third-party applications used in your project’s development or ongoing maintenance.
Extras
Depending on the nature of your project, you may need to purchase plugins or extra technical items to meet your website’s functionality requirements. Where possible, these will be included in your Scope of Work or, at the very least, discussed with you before commencement so you can make an informed decision.
Extras may require a monthly subscription, a single purchase, or an annual subscription. Failure to continue to pay for any premium products used in your project will have a detrimental impact on your site’s functionality.
JMJ–EA for a Day is not responsible for your website’s ongoing payments or subscription functionality.
Website Security
We will take all reasonable care to protect the data, content, materials, and files you supply for use in your project. However, we are not responsible for keeping backups or storing the data, content, or files you supplied to upload.
As the site owner, you are responsible for managing the data collected on your website.
Regular website maintenance, firewall services, security plugins, user access, strong passwords, and an SSL certificate (HTTPS) help protect your data and the data of users you collect. Your website security and how you gather and manage the data are your responsibility.
JMJ–EA for a Day cannot guarantee nor are we responsible for the reliability of your internet service, computers used, or data breaches, hacking or illegal mining of information.
Communication
Our preferred communication method is email. We will respond to your email within 24 hours of receipt during office hours AEST (Melbourne time).
If we contact you requesting information, content, images, or material for your project, we expect to hear back from you via email within 48 hours. We understand that sometimes you may not have what we are looking for, but acknowledging that you have at least received our email is welcome.
Communications received outside of office hours AEST will be responded to on the next business day. The only exception is if the next business day is a public holiday.
Office Hours
Monday to Friday, 9 am – 5 pm.
We are closed on all Australian National and Victorian public holidays.
Breach of Copyright & Intellectual Property
JMJ–EA for a day does not condone any breach of copyright or IP if what you provide is not yours or you do not have permission to use it. You are responsible for obeying all laws governing copyright and IP. JMJ reserves the right to ask you about any content, videos, images or materials you submit for your project.
Termination
You or JMJ have the right to terminate any project or web maintenance package at any time by providing 7 days’ written notification of termination, which can be an email from your email address or via our contact page. To easily identify you, please use the email address you shared with us to communicate with you when the project began. Should JMJ wish to terminate your project, we will contact you in writing via email to your nominated email account.
