The VA Project is operated by Jacqui James, trading as JMJ – EA for a Day (“we”, “us”, “our”). “You” or “User” means anyone who accesses our website or uses our free or paid programs.
By accessing this website or registering for The VA Project (free or paid), you agree to be bound by these Terms of Use. If you don’t agree, please don’t use our website or programs.
1. The VA Project
The VA Project helps virtual assistants build a virtual assistant business that changes their lifestyle. It’s offered in two ways:
Free Program: 8 foundational modules, delivered by email. No login required.
Paid Program: our full program, delivered via a members’ dashboard hosted on ThriveCart. You’ll receive an email notification each time a new module goes live, and you can access the module content by logging in to your ThriveCart dashboard.
We may add new modules, tools or resources to either program over time. These are automatically covered by these Terms of Use.
2. Eligibility
By using The VA Project, you confirm you’re 18 years or older and legally entitled to operate a virtual assistant business in your jurisdiction.
3. Paid Program – Pricing & Billing
- The Paid Program is a $69 (incl GST) per month subscription, billed automatically until you cancel, and you can cancel at any time.
- Payments are processed securely via Stripe and/or PayPal through ThriveCart.
- We reserve the right to change our pricing at any time. Existing subscribers will be notified before any change takes effect on their account.
- You’re responsible for keeping your billing details current and accurate.
Cancellation
You can cancel your subscription at any time by notifying us in writing, or via your ThriveCart dashboard. Cancelling stops future billing and no cancellation fees apply. You’ll retain access to the curriculum until the end of your current paid billing period.
Refunds
- We offer a 7-day money-back guarantee from the date of purchase, as we know life happens and you may not be ready yet, and that’s fine; we get it. Refunds may be minus any transaction fees charged by Stripe or PayPal.
- This refund policy sits alongside, and does not replace, your rights under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL that cannot lawfully be excluded, including your right to a remedy where the program is not delivered with due care and skill or is not fit for the purpose disclosed.
4. Access & Delivery
- The Paid Program is accessed via a personal dashboard on ThriveCart. You’ll need a working email address and internet access.
- The Free Program is delivered entirely by email and no login is required.
- We’re not responsible for access issues caused by third-party platforms (ThriveCart, your email provider, internet outages, etc.), though we’ll help troubleshoot as much as we can.
- We reserve the right to modify, pause or discontinue any part of either program, with reasonable notice to active paid subscribers where practical.
5. Acceptable Use
You agree not to:
- Use The VA Project for any unlawful purpose, or to breach any Australian or international law, regulation or ordinance.
Copy, resell, share, sublicense or distribute program content, in whole or part, without our written permission. - Share your login or dashboard access with anyone else.
- Upload or transmit viruses, malware, spam or anything designed to disrupt the program or platform.
- Scrape, crawl or systematically extract content from our website or program materials.
- Harass, defame, abuse or discriminate against any other person in community spaces, comments or feedback.
- Submit false or misleading information when registering or purchasing.
We reserve the right to suspend or terminate your access, without refund, if you breach any of the above.
6. Mindset & Personal Responsibility
Coaching and business-building touch many parts of your life, work, finances, and how you show up day to day. You’re responsible for how you apply what you learn in The VA Project, and for the decisions and actions you take as a result. We’re here to guide and support you, but we’re not liable for outcomes arising from how you choose to implement the material.
7. Intellectual Property
All content, tools, templates and materials within The VA Project (free or paid) are owned by Jacqui James / JMJ – EA for a Day and protected by copyright and intellectual property law. You may use them for your own business, but you may not resell, redistribute or claim them as your own.
8. Third-Party Tools & Affiliate Links
From time to time we may recommend third-party tools, or share affiliate links (always clearly identified). We’re not responsible for your experience with any third-party product or service. Please do your own research before purchasing or signing up.
9. Feedback
If you share feedback, good or otherwise, with us during the program or afterwards, you agree we can use it (in full or in part, edited or as-is) across our website, marketing and communications, without compensation. Providing feedback is always optional and never a condition of participating.
10. Disclaimer
Content shared through The VA Project is general guidance only; it is not professional legal or financial advice. You should seek your own professional advice before making any business decisions based on our material. To the maximum extent permitted by law, we disclaim liability for any loss arising from your reliance on this content.
11. Limitation of Liability
To the extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from your use of The VA Project. This does not limit any liability that cannot lawfully be excluded under the Australian Consumer Law.
12. Indemnity
You agree to indemnify Jacqui James and JMJ – EA for a Day against any claim, loss or expense (including reasonable legal fees) arising from your breach of these Terms or your violation of any law or third-party right.
13. Privacy
We collect and manage your information via ActiveCampaign (email/marketing) and ThriveCart (paid program access and billing). 14. Changes to These Terms
We may update these Terms from time to time. Continued use of The VA Project after changes are posted means you accept the updated Terms. Material changes affecting paid subscribers will be communicated by email.
15. Governing Law
These Terms are governed by the laws of Victoria, Australia, and any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
